Terms and conditions

Article 1 — Definitions

Seller: Calitex B.V., Fermiweg 51, 3542 CB Utrecht, the Netherlands. Buyer: the natural or legal person entering into an agreement with the seller. Consumer: a buyer not acting in the course of a profession or business.

Article 2 — Applicability

These terms apply to every offer by the seller and to every agreement concluded. Deviations apply only if agreed in writing.

Article 3 — Offer and prices

All prices on this website are in euros and include VAT unless expressly stated otherwise. The price excluding VAT is also shown for each product. Prices exclude shipping unless the order value exceeds the free-shipping threshold.

The seller is not bound by obvious errors or typing mistakes in the offer. Images are as true a representation as possible; colour deviation between screen and actual product may occur. Buyers are advised to order samples first.

Article 4 — Formation of the agreement

The agreement is formed when the seller confirms the order in writing or by email. An order placed through the website counts as a request; the seller confirms availability, lead time and final order value within one working day.

Article 5 — Payment

Payment is made through the payment methods offered by the seller, before dispatch, unless agreed otherwise in writing. For trade orders on account a payment term of 14 days from the invoice date applies.

Article 6 — Delivery

Stated lead times are indicative and never constitute a strict deadline. Delivery is to the first threshold at ground level. The buyer ensures the delivery address is accessible and that someone is present during the agreed slot. Risk passes to the buyer on delivery.

Article 7 — Inspection on receipt

The buyer inspects the consignment on delivery for visible defects and transit damage and signs the consignment note accordingly. Visible damage must be noted on the consignment note; failing that, the right to compensation from the carrier lapses. The buyer opens the packaging only after checking design and quantity.

Article 8 — Right of withdrawal

A consumer has the right to withdraw from the agreement within 14 days of receipt without giving reasons. Excluded from withdrawal are: opened packaging, installed floors, made-to-measure items and items which by their nature cannot be returned. The direct cost of return is borne by the buyer.

Article 9 — Warranty

The seller grants 20 years warranty against wear of the top layer on click floors and 15 years on dry-back floors, assuming normal domestic use. The warranty does not cover damage from incorrect installation, insufficient maintenance, mechanical damage, grit, water from a leak, or prolonged direct sunlight. The invoice serves as proof of warranty. This warranty does not affect the consumer's statutory rights.

Article 10 — Processing and installation

The buyer is responsible for the suitability and levelness of the subfloor and for following the installation instructions, including acclimatising the material and maintaining sufficient expansion space. By processing the material the buyer accepts the goods as sound; complaints about visible deviations in design or colour are not considered after processing.

Article 11 — Liability

The seller's liability is limited to the invoice value of the delivery concerned. The seller is not liable for consequential loss, including installation costs, lost income or the cost of removal and replacement. This limitation does not apply in cases of intent or wilful recklessness by the seller.

Article 12 — Complaints and disputes

Complaints must be submitted in full within a reasonable time of discovery. The seller responds within 14 days. Dutch law applies to all agreements. Disputes are submitted to the competent court in the seller's district, unless mandatory law provides otherwise.
